Trump Administration Appeals Injunction Blocking Birthright Citizenship Order

The Justice Department appealed to the Ninth Circuit Court of Appeals seeking to overturn a preliminary injunction that blocked President Trump's executive order attempting to end birthright citizenship. The executive order, signed on Inauguration Day (January 20, 2025), sought to deny citizenship to children born in the U.S. whose mothers were undocumented or on temporary visas and whose fathers were not citizens or lawful permanent residents. Multiple federal district court judges had issued nationwide injunctions blocking the order before its scheduled February 19, 2025 implementation date. The Ninth Circuit subsequently denied the administration's emergency request to lift the injunction, keeping the block in place and moving the constitutional battle closer to a potential Supreme Court showdown. This represents a direct challenge to the 14th Amendment's citizenship clause.
