E. Jean Carroll files upgraded lawsuit for battery under Adult Survivor Act
Carroll filed a new lawsuit against Trump for battery and defamation under New York's newly-enacted Adult Survivor Act, which temporarily lifted the statute of limitations for sexual assault claims. The upgraded suit was filed minutes after the law took effect at midnight. This second lawsuit alleged battery for the forcible rape and groping, in addition to defamation claims for Trump's continued denials. The Adult Survivor Act gave Carroll a one-year window to sue for the alleged 1990s assault despite the expired statute of limitations. Trump's lawyers had repeatedly refused to provide a DNA sample that Carroll requested to compare against the dress she wore during the alleged assault. The Washington Post noted the suit demonstrated 'that even a man as powerful as Trump can be held accountable.' This battery claim would proceed to trial while the original 2019 defamation suit remained tied up in appeals.
